Local 804 won a major arbitration victory that makes UPS pay part-timers their daily guarantee.

All UPS part-timers are guaranteed 3.5 hours of work for every shift as long as you report to work on time.

Members are guaranteed 3.5 hours a day as long as they report to work on time. If you get to work late, you are still entitled to 3.5 hours of work from your start time.

The contract requires UPS to pay a minimum of three hours pay to members even if they leave early. This right is laid out in a Memorandum of Understanding (MOU) on page 201.

Local 804 won a major arbitration victory on this issue.

“We went through daily recaps to make sure everyone was getting paid what they were owed,” said Dwight Virgo, a shop steward from the Nassau building. The daily recaps proved members were being sent home without their guaranteed pay.

“We filed grievances for all affected members using the MOU for members who were being sent home and paid less than three hours,” Virgo said.

Stewards in other buildings did the same. Working with the local, they built a strong case and won an arbitration decision that management cannot coerce members into waiving their three hour guarantee even if members go home before working three hours.

The arbitration decision in no way changes your right to a minimum of 3.5 hours of work per shift.
